It’s always good to see the trends about the growing number and importance of e-patients. Lee Rainie, director of the Pew Internet Project, presented this wonderful overview of the Project’s health findings at Providence St. Joseph Medical Center in Burbank, CA, on January 12.
Por su propia naturaleza, los contenidos compartidos en Twitter, enlaces a contenidos de terceros al margen, se limitan básicamente a dos, (i) contenidos de texto y (ii) fotografías realizadas por los propios usuarios enlazadas a través de aplicaciones como Twitpic, Instagram, Plixy o Yfrog, entre otros.
En primer lugar, ¿están ambos tipos de contenidos protegidos por el derecho de autor?; y, si es así, ¿puede el usuario de Twitter impedir que Twitter y los demás usuarios reutilicen sus contenidos? Ésta no es una cuestión nueva. Surge cada vez que una nueva tecnología irrumpe en el mercado, pero en el caso de Twitter su resolución es especialmente relevante puesto que se trata de la tercera mayor red social de Internet y el volumen de contenidos que en ella se comparten es cada día mayor.
Vayamos por partes. En lo que a los mensajes de texto se refiere, su protección desde el punto de vista del derecho de autor se antoja realmente complicada. Bajo el prisma del derecho español, la mayor parte de los tweets, por no decir todos, dificilmente gozaría de dicha protección por no cumplir el requisito de originalidad exigido por el artículo 10 de nuestra Ley de Propiedad Intelectual. Y es que, a la luz de los antecedentes judiciales, el hecho de que la extensión de los tweets esté limitada a 140 caracteres (apenas un par de lineas) hace prácticamente imposible alcanzar el nivel de originalidad requerido para la protección por derecho de autor. Por lo tanto, la facultad del autor de un tweet de impedir que un tercero reutilice ese tweet le estaría, en principio, vetada.
